Terms and Conditions For Artists
PARTICIPATION MODEL AND EVENT PROMOTION
1.1 The Artist acknowledges that the Gallery no longer charges fixed participation fees for exhibitions. Participation conditions are defined according to the subscription plan contracted by the Artist on Pice (pice.pro).
1.2 The Artist understands that exhibition opportunities (including virtual and physical exhibitions) depend on the active subscription plan and may vary accordingly.
1.3 The Gallery does not guarantee exclusivity. The Artist is free to exhibit and sell artworks through other platforms or venues.
1.4 The Artist is responsible for managing and maintaining their artworks on the Pice platform. All artworks registered on the platform may be displayed on picegallery.com and may also be included in exhibitions or partner showcases depending on the Artist’s plan.
1.5 The Gallery agrees to promote exhibitions collectively through its communication channels, including social media and newsletters.
AGENCY; PURPOSES
2.1 The Artist appoints the Gallery as a non-exclusive agent for the artworks listed on the platform for the purposes of exhibition and sale.
ACCEPTANCE OF ARTWORKS
3.1 Works of art may be accepted for exhibition or consignment only by persons designated by the Gallery.
3.2 The Gallery reserves the right to reject artworks at its sole discretion.
ARTIST'S WARRANTIES
4.1 The Artist warrants that they hold full and unencumbered ownership of the artworks and that all provided information is accurate.
4.2 The Artist guarantees the originality of the artworks and ownership of all related copyrights.
DIGITAL ASSET RESPONSIBILITY
5.1 The Artist is responsible for uploading and maintaining accurate and high-quality digital files on the platform according to the Gallery’s requirements.
5.2 Only artworks properly registered on the platform will be considered for exhibition and promotion.
5.3 The Gallery does not accept artworks created using artificial intelligence (AI), in whole or in part, nor artworks associated with or sold as NFTs (Non-Fungible Tokens).
5.4 By submitting artworks to the platform, the Artist declares that the submitted works are not generated by artificial intelligence and are not linked to any NFT or blockchain-based asset.
5.5 The Gallery reserves the right to remove, reject, or delist any artwork that violates this policy at its sole discretion, without prior notice.
AGE AND AUTHORIZATION
6.1 By agreeing to this Agreement, the Artist confirms they are at least eighteen (18) years old and legally authorized to enter into this contract.
ARTWORK DATA
7.1 All artwork details will be sourced from the Artist’s submissions on the platform and must be kept up to date by the Artist.
SALES AND PRICING
8.1 The Gallery will list the Artist's artworks on its platform and associated channels for an indefinite period, unless otherwise requested.
8.2 The Gallery may facilitate sales during and after exhibition periods in coordination with the Artist.
8.3 Pricing of artworks will be defined by the Artist, with the Gallery providing guidance if necessary.
8.4 All sales mediated by the Gallery are subject to a 15% commission (taxes included) on the final sale price.
8.5 The commission is automatically calculated through the Pice platform (pice.pro), ensuring full transparency. The Artist will always have clear visibility of the final sale price and the exact amount they will receive.
8.6 Discounts and promotions may be applied upon prior agreement with the Artist.
8.7 For direct sales occurring through Gallery-mediated exhibitions, the same commission structure applies.
8.8 Shipping costs may be added to the final price as agreed with the buyer.
8.9 The Artist must notify the Gallery within 5 business days if an artwork listed on the platform is sold independently.
GALLERY'S OBLIGATIONS
9.1 Promote and advertise the Artist’s artworks professionally.
9.2 Process payments to the Artist within 30 days after sales, deducting applicable commissions.
CONTRACT MODIFICATION
10.1 This Agreement may only be modified with mutual written consent between the Artist and the Gallery.
EXHIBITION CONDITIONS
11.1 Participation in physical and virtual exhibitions is subject to curatorial selection and the Artist’s active subscription plan.
11.2 The Artist must provide all required materials and information for exhibitions.
COMMITMENT TO EXHIBITION
12.1 Once selected for an exhibition, artworks should not be withdrawn before its conclusion, except under exceptional circumstances agreed upon with the Gallery.
DELIVERY AND PICKUP RESPONSIBILITY
13.1 The Artist is responsible for all logistics and costs related to the delivery and return of artworks for physical exhibitions.
13.2 Deadlines for delivery and collection must be respected as communicated by the Gallery.
DELIVERY CONDITIONS
14.1 Artworks must be delivered and collected in proper condition and packaging. Any damages must be reported immediately.
COPYRIGHTS AND INTELLECTUAL PROPERTY
15.1 The Artist retains full copyright ownership of their artworks.
15.2 The Gallery is granted the right to use images of the artworks for promotional purposes.
DATA PROTECTION (LGPD)
16.1 The parties agree to comply with the Brazilian General Data Protection Law (Lei nº 13.709/2018 - LGPD).
16.2 The Artist consents to the collection, processing, and storage of their personal data by the Gallery and the Pice platform for the purposes of account management, exhibitions, sales, and communication.
16.3 The Gallery undertakes to adopt appropriate security measures to protect personal data against unauthorized access, loss, or misuse.
CONFIDENTIALITY
17.1 Both parties agree to maintain confidentiality regarding sensitive information obtained through this Agreement.
GOVERNING LAW AND JURISDICTION
18.1 This Agreement shall be governed by the laws of the Federative Republic of Brazil.
18.2 The parties elect the jurisdiction of the courts of the city of Rio de Janeiro, State of Rio de Janeiro, Brazil, to resolve any disputes arising from this Agreement, waiving any other jurisdiction, however privileged it may be.
FINAL PROVISIONS
19.1 This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements.
19.2 By accepting this Agreement through the Shopify platform (including checkbox or digital acceptance), the Artist agrees that this constitutes a legally binding electronic signature.
